Regulations. Our ability to export* is contingent upon compliance with
EAR* & ITAR* as administered by the U.S. Department of Commerce
and the U.S. Department of State respectively. All exports are subject to commodity determination and, if required, an
export license.
The Optimax factory is a secure facility as prescribed in the Optimax Technology Control Plan. Our commitment to export compliance is company wide, all sales, supply chain and shipping personnel are trained on relevant export control regulations. Upon receiving a request for quote or purchase order involving an export, the purchaser will be required to complete our Export Compliance Form disclosing the details of the items end-use(s) and end-user(s). This information will be the starting point for determining what, if any, export controls apply. When appropriate, Optimax also screens suppliers for export compliance to ensure that a project’s regulatory status is not compromised.
*International Traffic in Arms Regulations (ITAR) are the US federal regulations controlling export and temporary import of defense-related articles and services designated on the US Munitions List. These regulations implement the provisions of the Arms Export Control Act (AECA). The Department of Defense Trade Controls under the Department of State interprets and enforces ITAR.
Please note, if your company is incorporated or organized to do business in the United States and your order is to be shipped to a destination within the U.S., then completion of the Export Compliance Form is not required and subsequent export compliance checks are not applicable.

*Export: Any oral, written, electronic or visual disclosure, shipment, transfer or transmission of commodities, technology, information, technical data, assistance or software codes to:- anyone outside the U.S. (including U.S. citizens)
- a non-U.S. individual wherever they are (deemed export)
- a foreign embassy or affiliate
